Oaks of Avent Ferry Condominium Association Board of Directors Meeting June 12, 2003 at 6:00 p.m.

Present:  Frank Johnson, Barbara Dodson, Bill Loftin, Bonnie Latham, Brian Browning, John Hertrick and Jeb Black - Management. Absent: none

Homeowner's Forum: No homeowners present.

Approved Motion to accept May meeting Minutes made by B Latham; seconded B Loftin.

Management Report:
1. 4211-19: Wood replacement nears completion, rain has caused delays. Extensive siding/wood replaced due to deterioration. Paint, roof, and gutter replacement are scheduled to follow, in that order.
2. Pothole in southern-side speed bump is re-filled.
3. 4291 requests removal of mulch debris and plant grass at earlier site of tree removal. Cost estimated at $75.00. Upon discussion, Board tabled request until fall, when grass planting is favorable. Site of tree removal at 4012 may also be considered then.
4. 4291 requests leveling of walkway raised by tree root. Management earlier received estimates of $400-500.  B. Loftin may have found a contractor for $300.  Board approved Motion made by B Dodson; second by J Hertrick to break and re-pour raised section of walkway for $300.  Bill & Jeb will work together to facilitate action.
5. Board notified that paint is deteriorating at top area of unit 4120; painted approx. 2-3 years ago. Not known if cause is environmental or bad paint. Board takes no action at this time.
6. 4265 requests Association pay one-half of attorney fees accrued for collection of dues in arrears until attorney fees issue is considered.  Board directed Management to request that the attorney waive fees in this case; decision is tabled until issue is resolved.
7. Management will report monthly emergency call responses in its future monthly reports to the Board.
8. Gutters scheduled for cleaning in June.

Treasurer's Report:  Association took legal action against 428? (CK #) to collect past-due monthly assessments plus attorney's fee. Decision was found that Association couldn't collect attorney fees, as our by-laws do not reflect State law that allows legal fees to be assessed to homeowners. Until by-laws are amended, the following legal fees are reversed from assessments:
a. 4113 - $585 legal fees deducted
b. 4124 - $585 legal fees deducted
c. 4269 - $65 legal fees deducted
d. 4273 - $75 legal fees deducted
e. 4275 - $705 legal fees deducted

Committee Reports:
Grounds:  None
Architectural:  4213 homeowner requests permission to pursue placing solar tubes in unit. Board granted permission to pursue request.

Unfinished Business:
1. Approved Motion made by B Loftin; second B Browning to verify with attorney by-law amendments pertaining to insurance deductible and collection of legal fees.
2. Draft letter to homeowners will be prepared for next meeting: B Browning will draft insurance part; J Black & B Browning will draft legal fees part. Drafts will be forwarded to Board for comment.
3. Approved Motion to change amount of Maximum Insurance Deductible to $5,000 made by B Latham; seconded by F Johnson.
4. Board decided not to re-bid audit costs at this time. Even though audit expense increased significantly this year, audit was let for bid two years ago when Merritt Petway CPA firm was lowest bidder.

Election of Committee Chairs: Current Chairs were reinstated. Architectural Chair: Frank Johnson, Grounds Chair: Brian Bowning, Newsletter Editor: Heidi Porter.
